Both during and after the dissolution process, the Court may award spousal support to one party. If spousal support is awarded during the dissolution process, it is considered “temporary” spousal support and further orders of the Court may terminate this type of award before a permanent award is determined. An award of spousal support after trial may be for a certain amount of time or it may be indefinite.

Types of Spousal Support

 

In Oregon, there are three distinct categories of spousal support:

  • Transitional spousal support: The intention of this category is to allow the party awarded support a set amount of time to reenter the work force and gain or continue education with the intention of becoming self-sustaining.

  • Maintenance spousal support: This category allows the party awarded support to maintain a similar standard of living they had become accustomed during the marriage and cannot wholly meet that standard through self-sufficiency alone. Most of the time, there is a noticeable disparity between the spouses' earning potential.

  • Compensatory spousal support: Awarded in limited circumstances when a spouse has made a significant financial or other contribution to the other spouse's education or career.
